DWI You Deserve the Best Possible Defense

Waco DWI Defense Attorney

Former Prosecutor Serving Clients Throughout Waco, TX

You may have had only one or two drinks before getting behind the wheel. You may have thought you felt “sober” enough to drive. You may have thought you could make it home without getting pulled over.

You may not have thought about how seriously DWI is treated in Texas. But it’s not too late.

Approximately every 20 minutes, someone is hurt or killed in an alcohol-related crash. The Texas Department of Transportation reported 812 fatal DWI crashes in 2019, a number that is too high in the eyes of law enforcement. Many people believe their DWI charge won’t result in harsh legal penalties, but that is far from the truth. A DWI accusation can rob you of your freedom, driving privileges and financial stability, which is why you must choose your legal defense wisely.

We can make that decision easier for you.

At The Greening Law Group, our founding lawyer is an award-winning criminal defense specialist and qualified forensic lawyer-scientist who is thoroughly trained in forensic chromatography. This field of specialty is essential in fighting DWI charges. As a former prosecutor with key insight into both sides of the law, our Waco DWI defense attorney can anticipate the prosecution’s attacks and prepare effective defense strategies in advance, increasing your chances of achieving a favorable outcome.

Texas DWI Laws

Driving while intoxicated (DWI) is strictly forbidden, as it can have fatal consequences. In Texas, it is illegal to drive with a blood alcohol concentration (BAC) of .08 or higher. People who are under 21 cannot drive with a BAC of .02 or higher, while commercial drivers are prohibited from driving with BAC of .04 or higher.

Depending on the circumstances of your DWI charges and criminal history, you may be subject to the following penalties:

First Offense

  • A fine of up to $2,000
  • Three days to 180 days in jail
  • Loss of driver license up to a year

Second Offense

  • A fine of up to $4,000
  • One month to a year in jail
  • Loss of driver license for up to two years

Third Offense

  • A $10,000 fine
  • Two to 10 years in prison
  • Loss of driver license for up to two years

DWI with a Child Passenger

You can get a child endangerment charge for DWI if you're carrying passengers younger than 15 years old. If convicted, you will face:

  • A fine of up to $10,000
  • Up to two years in a state jail
  • Loss of your driver license for 180 days

After two or more DWI convictions in five years, you must install an ignition interlock device (IID) that prevents you from driving if you’ve been drinking. Further DWI consequences include added driving points to your record, increased insurance rates and the loss of your livelihood. Without a driver’s license, you will be unable to commute to work and school, attend appointments, handle your children’s needs and satisfy other personal, family, professional and educational demands.
